Terms of Service

By engaging JoeKym Labs for web development services, you agree to the following terms and conditions.

1. Services

JoeKym Labs provides web development services including but not limited to:

• Website design and development
• Web application development
• UI/UX design
• Website maintenance and support
• Consultation and technical advisory

2. Project Process

2.1 Discovery & Quote

After initial consultation, a project proposal will be provided outlining scope, timeline, deliverables, and cost. The proposal must be approved before work begins.

2.2 Payment Terms

• 50% deposit required to start work
• Remaining 50% due upon project completion
• Additional revisions beyond agreed scope billed separately
• Maintenance packages billed monthly

2.3 Revisions

Each project includes 2-3 rounds of revisions during the design and development phases. Additional revisions may incur extra charges at an agreed hourly rate.

3. Client Responsibilities

Clients agree to:

• Provide clear project requirements and timely feedback
• Supply all necessary content (text, images, logos) on schedule
• Review deliverables within agreed timeframes
• Make payments according to the agreed schedule
• Secure necessary domain names and hosting (unless arranged otherwise)

4. Intellectual Property

4.1 Ownership

Upon final payment, the client owns the final codebase and design. JoeKym Labs retains the right to showcase the work in portfolios and marketing materials unless otherwise agreed in writing.

4.2 Third-Party Assets

Clients are responsible for licensing any third-party assets (stock photos, fonts, plugins). JoeKym Labs will inform you of any licensing requirements.

5. Limitation of Liability

JoeKym Labs is not liable for:

• Issues arising from client-provided content or third-party services
• Loss of data or business interruption
• Indirect, incidental, or consequential damages
• Problems caused by unauthorized modifications to the delivered work

6. Warranty

All projects are delivered as-is with no warranty beyond 30 days of bug fixes for issues caused by our code. This does not cover issues from client modifications, third-party integrations, or hosting problems.

7. Confidentiality

Both parties agree to keep confidential information private. This includes business strategies, proprietary code, and sensitive project details.

8. Termination

Either party may terminate the agreement with written notice. The client remains liable for payment for work completed up to the termination date. Deposits are non-refundable once work has commenced.

9. Governing Law

These terms are governed by the laws of Kenya. Any disputes shall be resolved through good faith negotiation or mediation in Nairobi.

10. Changes to Terms

These terms may be updated periodically. Continued use of services after changes constitutes acceptance of new terms.
